Mobility Equipment Hire Terms & Conditions

These Terms & Conditions apply to mobility equipment hired from Move Devon (“Move Devon”, “we”, “us” or “our”).
By making a booking, paying for a hire, accepting these Terms & Conditions or taking possession of our equipment, the customer (“you” or “your”) agrees to comply with these terms.
These terms apply to all equipment supplied by Move Devon, including mobility scooters, wheelchairs, commodes, toilet seat raisers and associated accessories.
1. Booking Equipment
Mobility equipment can be booked through the Move Devon website and online booking system.
Customers can select their equipment, required hire period and, where available, either delivery or collection.
A booking is not confirmed until the booking process has been completed and any required payment has been successfully received.
We reserve the right to decline or cancel a booking where we reasonably believe that the requested equipment is unsuitable for the intended user or intended use, where the equipment is unavailable, or where supplying it could present a safety risk.
2. Hire Period
Your hire period will be shown on your booking confirmation.
Equipment must be returned or made available for collection at the agreed date and time.
If you wish to extend your hire, please contact Move Devon before the original hire period expires.
Extensions are subject to equipment availability and payment of any additional hire charges.
Keeping equipment beyond the agreed hire period without our prior agreement may result in additional charges.
Returning equipment earlier than the agreed return date does not automatically entitle you to a refund for unused hire days.
3. Payment
Payment will normally be taken securely through our online booking system.
The total amount payable will be displayed before you complete your booking and may include:
- Equipment hire charges
- Delivery and/or collection charges
- Optional accessories
- Deposits, where applicable
- Any other charges clearly disclosed before payment
Where Move Devon agrees to an alternative payment arrangement, this will be confirmed separately.
A booking will not normally be confirmed until the required payment has been received.
4. Cancellation by the Customer
If you need to cancel your booking, please notify Move Devon as soon as possible.
Unless otherwise stated during the booking process:
More than 7 days before the hire commencement date:
You may cancel your booking and receive a refund of hire payments made, less any expressly stated non-refundable deposit or costs already incurred in connection with your booking.
Within 7 days of the hire commencement date:
Payments may be non-refundable because the equipment has been reserved for you and may no longer be available for hire to another customer.
Nothing in these terms affects any statutory rights you may have under applicable UK consumer law.
Where a statutory cancellation right applies, Move Devon will comply with those requirements.
5. Cancellation by Move Devon
Occasionally circumstances outside our reasonable control may prevent us from fulfilling a booking.
If Move Devon is unable to provide the equipment you booked, we may offer:
- Suitable alternative equipment;
- Alternative hire dates; or
- A refund of the amount paid for equipment we are unable to provide.
We will contact you as soon as reasonably possible if this occurs.
6. Equipment Supplied
Photographs and images displayed on our website are intended to provide a reasonable representation of the type of equipment available.
Unless a specific make or model is expressly confirmed as part of your booking, the exact make, model, colour or appearance of equipment supplied may vary.
Any substitute equipment will be intended to provide substantially similar functionality to the equipment booked.
7. Our Equipment Promise
Move Devon will take reasonable steps to ensure that hire equipment is:
- Maintained appropriately;
- Checked before hire;
- Clean and prepared for the customer;
- In suitable working condition; and
- Suitable for its stated intended purpose.
Where appropriate, operating instructions or a manufacturer's user guide will be made available.
A demonstration or explanation of the equipment can also be provided where reasonably required.
8. Customer Responsibilities
While equipment is in your possession, you are responsible for taking reasonable care of it.
You agree to:
- Use the equipment only for its intended purpose;
- Follow instructions provided by Move Devon and the manufacturer;
- Keep the equipment reasonably secure;
- Protect electrical equipment from excessive rain, water and other conditions that could cause damage;
- Store equipment appropriately when not in use;
- Charge battery-powered equipment in accordance with the instructions provided;
- Ensure the equipment is not overloaded beyond the manufacturer's stated maximum user weight;
- Use equipment only on terrain and gradients suitable for that equipment;
- Take reasonable precautions to prevent theft, loss or damage;
- Return all keys, chargers, manuals and accessories supplied with the equipment;
- Inform Move Devon promptly if equipment develops a fault or is damaged; and
- Stop using equipment where continuing to use it could reasonably be unsafe.
9. Mobility Scooter Use
Customers hiring mobility scooters must operate them responsibly and with reasonable care.
You must not operate a mobility scooter:
- While under the influence of alcohol or recreational drugs;
- While affected by medication that materially impairs your ability to operate the scooter safely;
- In a deliberately reckless or dangerous manner;
- Beyond the equipment's stated capabilities;
- On unsuitable terrain or gradients;
- With a passenger unless the equipment is specifically designed to carry one; or
- In circumstances contrary to the manufacturer's instructions.
You are responsible for assessing whether you are capable of safely operating the equipment.
If you are uncertain, please speak to Move Devon before using it.
10. Other Users
Unless otherwise agreed with Move Devon, equipment is hired for use by the person identified as the intended user when the booking is made.
You must not rent, sell, lend or otherwise dispose of Move Devon equipment to another person.
You must not allow another person to use the equipment where doing so would be unsafe or contrary to the terms of the hire.
11. Loss or Damage
Normal minor wear and tear resulting from reasonable use is expected and will not normally result in a charge.
However, you may be responsible for reasonable repair or replacement costs where equipment is lost or damaged because of deliberate, reckless, negligent or improper use, subject to applicable law and the circumstances of the loss or damage.
We may charge for lost or damaged accessories.
Indicative replacement charges include:
Lost or damaged keys: up to £15
Lost or damaged user manuals: up to £15
Lost or damaged charging equipment: up to £100
Where the equipment itself is damaged, we will assess the damage and provide details of any amount we reasonably seek to recover.
The old blanket “up to £1,000” wording has deliberately not been carried over as an automatic charge. Any charge should reasonably relate to the actual loss or damage and applicable consumer law.
12. Faults and Breakdowns
If equipment develops a fault, stop using it where continued use could be unsafe and contact Move Devon as soon as reasonably possible.
Do not attempt significant repairs or alterations yourself unless specifically authorised by Move Devon.
We will assess the problem and, where appropriate and reasonably possible, arrange repair, replacement equipment or another suitable solution.
13. Theft
If Move Devon equipment is stolen while in your possession, you must:
- Contact the police as soon as reasonably possible;
- Obtain a crime reference number;
- Notify Move Devon promptly; and
- Provide us with the crime reference number and any relevant information reasonably requested.
You must take reasonable precautions to secure equipment against theft throughout the hire period.
14. Delivery
Where delivery is selected, the customer is responsible for providing a complete and accurate delivery address.
Move Devon may deliver to locations including:
- Residential addresses
- Hotels
- Holiday parks
- Holiday cottages
- Other agreed accommodation or locations
You must ensure that somebody is available to receive the equipment where required.
We may require proof of identity before releasing equipment.
We will make reasonable efforts to deliver within the agreed period. However, delivery times may be affected by traffic, weather, previous deliveries and circumstances outside our reasonable control.
15. Collection from Move Devon
Where customer collection is available and selected, equipment will be made available at the agreed collection location and time.
You are responsible for ensuring that your vehicle is suitable for transporting the equipment.
Some mobility scooters and other equipment may be heavy or require dismantling before transportation.
Please contact us before collection if you are unsure whether the equipment will fit safely within your vehicle.
16. Return and Collection
At the end of the hire period, equipment must either be:
Returned to the agreed Move Devon location, or
Made available for collection at the agreed address, depending on the option selected when booking.
Equipment should be returned in substantially the same condition in which it was supplied, allowing for reasonable wear and tear.
Move Devon may inspect equipment following its return.
17. Cleaning and Condition
Customers should take reasonable care to keep hire equipment in an appropriate condition.
Where equipment is returned requiring cleaning significantly beyond what would reasonably be expected from ordinary use, Move Devon may seek to recover reasonable additional cleaning costs where permitted.
Please contact us if equipment becomes significantly soiled or contaminated during the hire period so that appropriate arrangements can be made.
18. Commodes and Toilet Seat Raisers
Commodes, toilet seat raisers and similar equipment must be used in accordance with the instructions provided.
The customer is responsible for ensuring that the equipment is appropriately positioned and suitable for the intended user.
Where there is any uncertainty about whether a particular product is appropriate for someone's medical, mobility or accessibility needs, appropriate professional advice should be obtained.
Move Devon supplies mobility equipment for hire and does not provide medical diagnosis or clinical advice through the booking process.
19. Accidents and Incidents
Any accident or significant incident involving Move Devon equipment should be reported to us as soon as reasonably possible.
Where appropriate, please provide:
- Your name;
- Booking reference;
- Equipment involved;
- Date and time of the incident;
- Location;
- Brief description of what happened; and
- Details of any damage to the equipment.
In an emergency, contact the appropriate emergency services before contacting Move Devon.
20. Insurance
Move Devon maintains appropriate business insurance for its operations.
The existence of Move Devon's insurance does not remove the customer's responsibility to use and care for hired equipment appropriately.
Details of relevant insurance cover can be provided where appropriate upon request.
Customers should check whether they require any additional personal insurance for their particular circumstances or intended use.
21. Safety
Move Devon reserves the right to refuse to provide equipment where we reasonably believe doing so would create an unacceptable safety risk to the customer, another person or the equipment.
Customers should provide accurate information when booking, particularly where information such as the intended user's approximate weight, mobility requirements or intended use is relevant to selecting suitable equipment.
22. Customer Information
You are responsible for ensuring that information supplied during the booking process is accurate.
This includes:
- Name
- Contact details
- Delivery address
- Hire dates
- Intended equipment requirements
- Any information specifically requested to determine equipment suitability
Incorrect information may prevent or delay delivery.
23. Data Protection & Privacy
Move Devon will process personal information in accordance with applicable UK data protection legislation and our Privacy Policy.
Information may be used where reasonably necessary to:
- Process and administer bookings;
- Take payment;
- Deliver and collect equipment;
- Communicate with customers;
- Maintain appropriate business records;
- Handle incidents, complaints or claims; and
- Meet legal and regulatory obligations.
We will not use your information for unrelated marketing where consent is required unless the appropriate consent has been obtained.

24. Online Booking & Electronic Acceptance
Bookings made through the Move Devon website may require customers to confirm that they have read and accepted these Terms & Conditions.
Where an electronic signature, checkbox or other digital acceptance mechanism is provided, completing that process forms part of the booking record.
Customers should read these terms before completing payment.
A copy of, or link to, the applicable terms should be retained with the customer's booking confirmation where practicable.
25. Refunds
Refunds will be considered in accordance with:
- These cancellation terms;
- The circumstances of the booking;
- Whether the hire has commenced;
- Whether equipment has already been delivered or prepared; and
- The customer's statutory rights.
Nothing in this policy limits rights that cannot lawfully be excluded under UK consumer law.
26. Complaints
If you are unhappy with any aspect of your booking or equipment, please contact Move Devon as soon as possible so that we have an opportunity to investigate and resolve the matter.
Please provide your booking reference wherever possible.
27. Changes to These Terms
Move Devon may update these Terms & Conditions from time to time.
The terms applicable to your hire will normally be those presented to you when your booking is made, subject to any changes required by law.
28. Governing Law
These Terms & Conditions are governed by the laws applicable in England and Wales.
Nothing in these terms affects any statutory consumer rights that cannot legally be excluded or restricted.
